UOC community’s lawyer denounces “excuses” of Rovno RSA
Earlier head of Rovno RSA Aleksey Muliarenko stated that the court had allegedly declined a lawsuit, lodged by the UOC community in Riasniki, on recognizing its decision to have alternate divine services in the local church as unlawful. This time the governor’s press-secretary published a document which, in his opinion, proves Muliarenko’s words.
“Today I saw an article on “Radio Track” site with a bumped-up title “Dotting all i’s” in accusation of Rovno RSA: court ruling.” Indeed, Sergey Minich (press-secretary of the head) shows the court ruling on consideration of the procedural request, and right here – heads up, everybody – on taking actions to secure the claim,” wrote the community’s lawyer.
Further on the lawyer details why this document cannot serve as an excuse for the governor’s application: “The lawsuit was filed on 10 November 2016, together with the procedural request to take actions on its security, which under part 1 of article 118 of the Code of Administrative Court Procedure of Ukraine is to be considered not later than the following day upon its reception, i.e. on 11 November 2016. This is what the court did: it simply considered the request without making any decision on the matter!”
“A final decision hasn’t been made, and all i’s in the case haven’t been dotted. The first court session is scheduled for 6 December 2016,” underscored the UOC Community’s counsel and advised RSA staff members to read documents more carefully.
The lawyer also published a screenshot from the site of Rovno district administrative court with the trial date.
