The court obliged the Kyiv Metropolis of the UOC to return to the state ownership the Assumption (St George's) Cathedral of the XII century in Kaniv, Cherkasy region, which is an object of cultural heritage of national importance, reports the Prosecutor General's Office.
The prosecutors demanded that the decision of the Kaniv City Council, which in 2003 granted permission to the Ukrainian Orthodox Church to register ownership of the archaeological monument, be declared illegal and cancelled. This subsequently served as the basis for the registration of the collective ownership right. The prosecution referred to the fact that the law expressly prohibits the alienation of state-owned cultural heritage monuments.
The court satisfied the claim of the district Prosecutor's Office in the interests of the Ministry of Culture and Information Policy of Ukraine against the Kaniv City Council executive committee and the Kyiv Metropolis of the UOC.
As previously reported, the Cherkasy Eparchy was deprived of the land around the cathedral.
